Agreement between Safari Yatri and User

This Agreement is made between you and Safari Yatri Pvt. Ltd. ("us", "we", "our", "Safari Yatri"). It sets out the various terms under which Safari Yatri offers you its services. By using any of the services and/or the website and mobile application, you agree that you have read and accepted these terms and conditions and that they shall apply to your use.

SAFARI YATRI PVT. LTD., a private limited company incorporated under the laws of Nepal, having its registered office at Itahari, Koshi Province, Nepal (hereinafter referred to as "Safari Yatri"), which expression shall, unless repugnant to the context and meaning hereof, include its successors and assigns.

A Driver is an independent person who has obtained a valid license from the concerned government authority of Nepal to drive a passenger vehicle and has been verified by Safari Yatri to provide transportation services as requested by the Passenger.

A Passenger is the person who uses the Safari Yatri platform to request and book rides from Drivers.

You agree to these Terms by either confirming your acceptance in the Safari Yatri application or by using any part of the Platform.

1Services

1.1. Safari Yatri provides the Passenger with an internet-based platform to connect with independent Drivers for personal transportation services. Safari Yatri itself does not provide transportation services. Drivers are independent service providers and will provide rides directly to Passengers.

1.2. Once a Passenger confirms a Driver, a separate agreement is formed between the Passenger and the Driver. Safari Yatri shall not be held responsible for any disputes, conflicts, or failures in the completion of the ride between Passenger and Driver.

1.3. Safari Yatri provides safety features such as driver verification, and an in-app emergency contact option, but cannot assure the safety or reliability of offline interactions.

2Account Registration and Requirements

2.1. To use the Platform, you must:

• Be at least 18 years old (or use under parental guidance).

• Provide accurate, current, and complete information during registration.

2.2. Initially, all users register as Passengers. To become a Driver, users must:

• Pass manual verification by Safari Yatri admins.

3Use of the Platform and Services

3.1. You may not reproduce, modify, display, sell, or distribute any Safari Yatri materials without express consent.

3.2. You shall not use the Platform to transmit unlawful, harmful, or offensive material, or attempt to manipulate fares, matchings, or bypass Safari Yatri's system.

3.3. You shall not contact Drivers or Passengers outside Safari Yatri's system to avoid paying commission. If found, Safari Yatri may blacklist you from the Platform.

3.4. Safari Yatri reserves the right to suspend or terminate your access for violations of these Terms.

4Communication Policy

4.1. Communication tools within the app must only be used for ride-related purposes.

4.2. Harassment, unwanted contact, or misuse of communication tools is prohibited.

4.3. Safari Yatri does not record or monitor calls or messages between Drivers and Passengers.

5Intellectual Property

5.1. Safari Yatri owns all intellectual property rights in its Platform, including design, logos, content, and source code.

5.2. You are granted a limited, non-transferable, revocable license to use the Platform for personal use.

5.3. You may not copy, reverse-engineer, resell, or misuse any part of the Platform.

6Third-Party Services

6.1. Safari Yatri uses third-party services such as GalliMaps for location and routing.

6.2. Use of such services is subject to their respective terms and policies. Safari Yatri is not liable for errors or damages caused by third-party data.

7Limitation of Liability

7.1. Safari Yatri shall not be held liable for:

• Injuries, loss, or damages during rides.

• Misunderstandings or disputes between Passengers and Drivers.

• Service disruption, technical issues, or downtime.

7.2. All risks in relation to rides are solely between the Passenger and the Driver.

8Termination and Suspension

8.1. Safari Yatri may terminate or suspend your account if you:

• Breach these Terms or laws of Nepal.

• Provide false information.

• Attempt to manipulate the Platform.

8.2. You may terminate your account anytime by contacting Safari Yatri.

9Indemnification

You agree to indemnify and hold Safari Yatri harmless from any claims, damages, liabilities, or expenses arising from your use of the Platform or violation of these Terms.

10Force Majeure

Safari Yatri shall not be held liable for delays or failures due to events beyond reasonable control, including but not limited to natural disasters, strikes, system failures, or government actions.

11Notices

Any notices shall be provided in writing through email, SMS to the contact details registered with Safari Yatri.

12Severability

If any provision of this Agreement is deemed invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.

13Changes to Terms

Safari Yatri reserves the right to revise these Terms at any time. Updates will be notified via the app or website. Continued use of the Platform constitutes acceptance of revised Terms.

14Governing Law and Jurisdiction

This Agreement shall be governed by the laws of Nepal, and any disputes shall be resolved in the courts of Nepal.
